Werner gets a win in court | #190

Werner Enterprises has been in a court battle since 2011. A group of trainee driver allege Werner did not pay them for breaks and sleeper time, only $350 a week salary. The sleeper was thrown out but the break stuck and initially Werner lost and was ordered to pay $800000. Well, since math is hard the figures had to be refigured and were turned in late. Werner objected and has won three appeals based on that. Look at how much effort a trucking company will go through to not pay you. Think about it.   I am not a lawyer and this is not legal advice. Seek a licensed attorney of your choice for legal advice. This podcast is opinion.

Werner Enterprises loses $36,000,000 lawsuit | #166

A Deaf driver applied to Werner after completing Roadmaster truck driving school.  Did you know Werner Enterprises owns Roadmaster?  Anyway, he got an exemption and passed his DOT physical, passed truck school and applied to Werner.  Werner said no thank you to him and he wasn’t having any of it.  I totally agree.  It would appear to me, who is not a lawyer, that the only reason Werner did not hire him is because he is Deaf.  As you know I am learning American Sign Language so he could come work with me.  He complained to the EEOC and after trying to reach a settlement they sued Werner and won.  They had a jury.  Attention:  I am not an attorney and this show is not legal advice or a legal opinion.  Seek a licensed attorney for legal advice.

Why the Werner court case is important | #135

Werner recently appealed a ruling in which they lost.  They also lost the appeal and now currently owe $100,000,000. Yes, ONE HUNDERED MILLION DOLLARS.  I think this is a good thing in trucking and I tell you why.

Trucking Lawsuits | Tesla Semi by the numbers | Weird State Laws | #132

In a state of confusion episode I discuss the new Tesla semi and how much energy it needs to use.  Also, how much that costs.  Trucking lawsuit settlements are in the news.  If a company wants to have a 24/7 camera in the truck and totally micromanage us then yes, they should be 100% responsible for what happens on the road and pay through the nose for it.  I have a solution to the truck parking problem.  Some weird state laws are up today sent in by an astute listener.

Trucking Answers | Unabridged | Werner buys Baylor | A Reason we are not on Mars | #123

In this hair-raising episode I discuss Werner Enterprises buying Baylor Trucking.  Werner says nothing will change at Baylor.  We will see.  Is using hair for drug testing discrimination?  Should it be done?  A Reason we are not on Mars.

Trucking Answers | Unabridged | A Reason we are not on Mars | #121

In this pumpkin spice flavored episode I discuss Werner and Kodiak and the pact they have to move freight without drivers.  They start their first lane soon and it will be working the exact way I said so I believe that they listen to the podcast.  I-80 in Illinois will be under construction near Minooka until 2027.  Are you ready for that?  The Natural Propane Gas Association wants to be able to work the drivers 17 hours a day and drive for 14 of those hours.  Who wants to work for 17 hours a day?  Tesla has a robot named Optimus that is going to probably take over the world as soon as it can.  Topeka, Kansas shows us why we don’t live on Mars and may never.  Also, a new driver facing cam gives gold stars for good driving.

In this likely Grammy nominated episode I discuss the Constitution.  Also, CR England may be involved in a Class Action.  Speaking of Class Action, Werner is also on the list.  Same companies all the time.  Weird.  Electric cars are now racist.  A reason we are not on Mars.

Trucking Answers | Top 100 For-Hire Carrier Discussion | #89

In a belted out episode I discuss the top 100 for-hire carriers in the United States.  I go over the top 10 and then selected ones from the rest of the list.  Is your carrier a top-100 carrier?  There are good and bad in the list so just because you are at a big place doesn’t mean it is bad or good.  Let’s take a look at the list.

Trucking Answers | Pay raises | Driver Churn | Automotive News | A Reason we are not on Mars | #79

In an episode that will likely go to the Petersen Museum I discuss driver churn in the trucking industry and what the ATA has to say about it.  They love it!  Is it good for you?  Walmart raises their pay and will now take students.  Nice.  Tesla semi may be out next year, maybe not.  Someone bought a Dodge Dart this year.  The problem is they stopped making them in 2016!  A Reason we are not on Mars.
